Subcontractors may be engaged for purposes such as managing the commercial relationship between Buyers and Sol-Hair, providing sales and supply services, payment processing and invoicing, ensuring the execution of tasks and back-office operations (including technical and operational support necessary for the Website's functioning), and other necessary or convenient tasks.
Subcontractors engaged by Sol-Hair will implement all technical and organizational measures required to protect the personal data provided, ensuring the rights and interests of the data subjects.
2. Collection and Processing of Personal Data
Access to and mere use of the Website by Users does not involve the collection or processing of personal data. However, when a User creates an account on the Website, certain data will be collected, depending on its associated purpose. General Terms of Sale (GTS)
Transactions involving products via Sol-Hair's e-commerce are subject to Portuguese legislation and governed by the following conditions:
A. Purchase and Sale
- Products are presented on the Website with descriptions that allow Buyers to understand their essential features and price.
- Buyers select the Product(s) they wish to purchase.
- Buyers confirm their choice of Product(s) and acknowledge and accept the GTS by clicking to validate.
- Buyers receive an email confirming the acceptance of their order. However, the purchase and sale contract between Buyers and Sol-Hair remains subject to the condition of Product availability.
- Sol-Hair makes every effort to ensure the Website's information is accurate. However, errors may occur. If a pricing or description error is found for an ordered Product, Sol-Hair will contact the Buyer as soon as possible to cancel the order and refund any amounts paid. Alternatively, if feasible, the Buyer may confirm the order under the corrected conditions.
- If a Product is ordered simultaneously by multiple Buyers, it will be sold to the first Buyer who registers and pays for the order. Orders submitted by others will be canceled.
- Once the order is validated by Sol-Hair, communication is sent to the Buyer (via email, SMS, or other) to confirm the order shipment or cancellation.
- Upon confirmation of all or part of the order, the resolved condition in the contract ceases, and Sol-Hair is definitively committed to shipping the order.
- In the absence of confirmation of Product availability, the contract is automatically terminated, and both parties are released from obligations, except for contracts related to unavailable Products.
10. In case of confirmation of the availability of all or part of the Products ordered by the Buyer, the mentioned Products will be shipped by Sol-Hair.
B. Price and Payment
1. The purchase price of the Product is set by Sol-Hair. Prices are listed in euros, inclusive of all taxes, excluding delivery charges, which are added before order confirmation.
- Buyers must provide their taxpayer identification number at the time of order if they require an invoice.
C. Shipping and Delivery Costs
1. Sol-Hair provides various delivery methods based on the Products.
- Buyers select the method, timeframe, and costs during purchase.
D. Right of Withdrawal
1. Under current law, Buyers have 14 days from receipt of the ordered Product(s) to exercise their right of withdrawal without compensation or justification.
2. Cosmetic and personal hygiene products cannot be returned (Decree-Law 296/98, of September 25).
3. For withdrawals within the above timeframe, only the purchase price and shipping costs are refunded. Return costs are borne by the Buyer.
4. Products must be returned in their original state (packaging, accessories, instructions, etc.) within 14 days of notifying the Seller of the withdrawal.
5. Refunds for returned Products will be made as promptly as possible.
E. Sol-Hair Obligations
1. Sol-Hair complies with all professional obligations regarding the Products sold on the Website, including consumer goods warranty laws.
2. Sol-Hair is committed to making every effort to fulfill its obligations in the best possible way, providing quality service to the Buyers.
3. The purchase and sale contracts for the Products offered by Sol-Hair Lda. on the Website are concluded between Sol-Hair Lda. and the Buyer under the resolutive condition of the Product being available.
F. Jurisdiction for Consumer Disputes
In the event of a consumer dispute, as defined by Lei nº. 144/2015, of September 8, the consumer may resort to the competent alternative dispute resolution entity.
